By accessing or using this website, you agree to be bound by these Terms.

2. Eligibility

3. Products and Availability

Product availability is not guaranteed until your order has been accepted and processed.

We reserve the right to:

  • Refuse orders
  • Cancel orders
  • Correct pricing errors
  • Modify product descriptions
  • Discontinue products without notice

4. Pricing

Prices are subject to change without notice.

Although we strive for accuracy, pricing or product information may occasionally contain errors.

If an error occurs, we reserve the right to cancel the order and issue a full refund.

5. Payment

Payment authorization occurs at the time an order is placed.

Orders are subject to fraud prevention review and payment verification.

6. Third-Party Fulfillment

Many products available through MyEliteProducts are fulfilled by independent third-party suppliers.

Shipping times, inventory availability, and product availability depend upon these suppliers.

Although we coordinate fulfillment, delays may occur because of:

  • Inventory shortages
  • Manufacturer delays
  • Shipping carrier disruptions
  • Natural disasters
  • Weather
  • Force majeure events

Estimated delivery dates are not guaranteed.

7. Shipping

Shipping estimates are provided as a convenience only.

Risk of loss transfers to the customer upon delivery by the shipping carrier.

8. Returns and Refunds

Returns are governed by our Return Policy.

Certain products may not be eligible for return because of manufacturer restrictions, health regulations, customization, or other limitations.

9. Warranties

Manufacturer warranties remain the responsibility of the manufacturer unless expressly stated otherwise.

MyEliteProducts does not independently warrant products except where required by law.

  • Graphics
  • Text
  • Images
  • Software
  • Design
  • Trademarks

are owned by Elite Business Strategies, LLC or licensed to MyEliteProducts and are protected by applicable intellectual property laws.

11. Acceptable Use

Users agree not to:

  • Interfere with website operation
  • Use automated systems to scrape data
  • Upload malicious software
  • Commit fraud
  • Violate applicable laws

12. Disclaimer

THE WEBSITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYELITEPRODUCTS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Limitation of Liability

To the fullest extent permitted by law, Elite Business Strategies, LLC, its officers, employees, affiliates, suppliers, fulfillment partners, licensors, contractors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from the use of the website or products.

Our total liability shall not exceed the amount paid for the applicable order.

14. Indemnification

You agree to defend, indemnify, and hold harmless Elite Business Strategies, LLC and its affiliates, suppliers, officers, employees, contractors, and partners from any claims, damages, losses, liabilities, costs, or expenses arising out of your use of the website, violation of these Terms, or infringement of the rights of another party.

15. Force Majeure

We shall not be liable for delays or failures resulting from events beyond our reasonable control, including acts of God, natural disasters, pandemics, labor disputes, governmental actions, cyberattacks, utility failures, transportation interruptions, or failures by third-party suppliers or carriers.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles.

Any legal action shall be brought in the state or federal courts located in Leon County, Florida, unless otherwise required by applicable law.

17. Changes to Terms

We reserve the right to modify these Terms at any time.

Continued use of the website constitutes acceptance of any revised Terms.

18. Marketplace and Third-Party Supplier Disclosure

MyEliteProducts is an online retail marketplace operated by Elite Business Strategies, LLC. We offer products sourced from a network of manufacturers, distributors, wholesalers, marketplace partners, and other third-party suppliers ("Suppliers").

Many products listed on the Website are supplied, warehoused, fulfilled, or shipped directly by these Suppliers. Product descriptions, specifications, images, pricing, availability, compatibility information, technical data, and warranty information may be provided by the Supplier and are believed to be accurate at the time of publication; however, MyEliteProducts does not independently verify all such information and cannot guarantee its completeness, accuracy, or currency.

Because inventory levels and pricing are managed by third-party Suppliers, product availability displayed on the Website does not constitute a guarantee that an item is in stock at the time an order is placed. We reserve the right to cancel or modify any order when a product becomes unavailable, is discontinued, or contains pricing or listing errors. In such cases, customers will receive a refund of any amounts charged for unavailable items.

Unless expressly stated otherwise, MyEliteProducts is not the manufacturer of the products offered for sale. Manufacturer warranties, recalls, product safety notices, and technical support remain the responsibility of the applicable manufacturer.

19. Supplier Disclaimer

MyEliteProducts makes commercially reasonable efforts to partner with reputable Suppliers; however, we cannot guarantee the accuracy of information supplied by third parties.

Without limiting the foregoing:

  • Product images may differ from the actual product.
  • Product packaging may change without notice.
  • Manufacturer specifications may change after publication.
  • Colors displayed on electronic devices may not accurately represent actual product colors.
  • Product dimensions and weights are approximate unless otherwise stated.
  • Accessories shown in photographs may not be included unless specifically identified in the product description.

MyEliteProducts reserves the right to correct any product description, specification, compatibility information, image, availability, pricing, or typographical error at any time without prior notice.

We shall not be liable for inaccuracies originating from manufacturers or third-party Suppliers, provided that we promptly correct such information once discovered.

20. Sales Tax Collection

Applicable federal, state, and local sales, use, excise, environmental, recycling, or other transaction-based taxes will be calculated and collected where required by applicable law.

The amount of tax charged is determined based on factors including, but not limited to:

  • Shipping destination
  • Product category
  • Applicable tax exemptions
  • Current tax rates
  • Changes in tax laws

Customers claiming tax-exempt status must provide valid documentation before an order is processed. Failure to provide acceptable exemption documentation may result in applicable taxes being charged.

Customers remain solely responsible for any taxes not collected that are legally owed under applicable law.

21. Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Agreement to Arbitrate

Except where prohibited by applicable law, any dispute, claim, controversy, or cause of action arising out of or relating to these Terms, your use of the Website, or any purchase made through MyEliteProducts shall be resolved exclusively through final and binding arbitration rather than in court.

Arbitration shall be administered by the American Arbitration Association ("AAA") under its applicable Consumer Arbitration Rules unless the parties mutually agree otherwise.

The arbitration shall take place in Leon County, Florida, unless another location is required by law or agreed upon by the parties.

The arbitrator shall have exclusive authority to resolve disputes concerning the interpretation, enforceability, applicability, or formation of this arbitration provision.

Informal Resolution

Before initiating arbitration, either party agrees to provide written notice describing the dispute and allow the receiving party thirty (30) days to attempt to resolve the matter informally.

Exceptions

Nothing in this section prevents either party from:

  • Filing an individual action in small claims court where jurisdiction exists;
  • Seeking temporary, preliminary, or permanent injunctive relief to protect intellectual property, confidential information, or proprietary rights; or
  • Pursuing remedies where arbitration is prohibited by applicable law.

Class Action Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL CLAIMS MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY.

YOU AND MYELITEPRODUCTS EACH WAIVE ANY RIGHT TO PARTICIPATE AS A PLAINTIFF, CLASS MEMBER, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL IN ANY CLASS ACTION, MASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.

The arbitrator may award relief only on an individual basis and may not consolidate the claims of multiple parties or preside over any representative or class proceeding.

Jury Trial Waiver

TO THE EXTENT PERMITTED BY LAW, BOTH PARTIES KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY FOR ANY DISPUTE SUBJECT TO THIS ARBITRATION AGREEMENT.

Severability

If any portion of this Arbitration and Class Action Waiver is found unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.

23. Entire Agreement

These Terms of Service, together with our Privacy Policy, Shipping Policy, Return and Refund Policy, and any additional policies referenced on the Website, constitute the entire agreement between you and Elite Business Strategies, LLC concerning your use of MyEliteProducts and supersede all prior or contemporaneous communications, representations, and agreements relating to the Website or purchases made through it.
